TOPLINE: Each day, the crisis along the U.S.-Mexico border is getting worse. Democrats refuse to acknowledge that their radical policies have created the surge of migrants unlawfully entering the United States. Instead of encouraging President Biden to reverse his reckless executive orders that caused this national security, health, and humanitarian crisis, Speaker Pelosi and House Democrats are putting two bills on the Floor this week that will only make things worse and encourage more migrants to illegally enter the country.

Migrants Are Surging at the Border

This week, the U.S. House of Representatives will vote on H.R. 1333, the “National Origin-Based Antidiscrimination for Nonimmigrants Act,” known as the “NO BAN Act,” and H.R. 1573, the Access to Counsel Act.

Both pieces of legislation will do nothing to fix the crisis at the southern border, and will actually make it worse.

Customs and Border Protection announced that it had encountered more than 172,000 migrants attempting to illegally enter the United States through the southwest border in March.

This is a 71 percent increase in encounters in just one month.

This fiscal year, Customs and Border Protection has already had over 569,800 encounters with illegal immigrants. This represents a 24 percent increase from the total encounters during Fiscal Year 2020, when migration was limited by COVID-19, and a 34 percent increase from approximately the same time frame in Fiscal Year 2019.

President Biden tapped Vice President Harris to lead the Biden Administration’s response to the humanitarian and security crisis, however, instead of visiting the southern border, Vice President Harris has traveled to a water facility in California, a bakery in Illinois, and a yarn shop in Virginia.

Vice President Harris’ failure to take the border crisis seriously and history of disrespectingimmigration officers is appalling. In 2018, then-Senator Harris compared Immigration and Customs Enforcement to the Ku Klux Klan during her questioning of Ronald Vitiello, President Trump’s nominee to lead ICE.


The “No BAN Act” Makes Biden’s Border Crisis Worse

The “No BAN Act” bolsters House Democrats’ assault on successful Trump Administration immigration policies and weakens our national security.

This legislation strips the President’s ability to reject migrants if their entry would be detrimental to the national interests and transfers the right to deny entry to the Secretaries of State and Homeland Security — unelected cabinet officials who are not directly accountable to the American people.

In addition, H.R. 1333 changes Section 212(f) of the Immigration and Nationality Act so that illegal aliens are more likely to be granted a waiver of exclusion and be allowed to enter the United States.

This legislation does nothing to fix President Biden’s self-made border crisis and makes it easier to sue the U.S. government. H.R. 1333 calls for specific judicial review of denials of entry and includes vaguely worded phrases like “compelling government interest,” “harmed by a violation,” and “least restrictive means” that will increase the litigation from pro-amnesty organizations on behalf of illegal immigrants. The Access to Counsel Act Makes It Harder to Secure the Border

The Access to Counsel Act would negatively impact Custom and Border Protection’s ability to efficiently review millions of travelers and goods brought into the United States and would cost American citizens hundreds of millions of dollars.

H.R. 1573 would provide access to legal representation for travelers referred to secondary inspection at a port of entry instead of providing access to counsel when and if that traveler becomes the focus of a criminal investigation. (Courtesy of House Judiciary Committee Republicans.)

The Congressional Budget Office estimates that the Access to Counsel Act would cost an estimated $825 million over five years in order to hire additional personnel at each port of entry, provide security and transportation for each individual seeking access to counsel, upgrade current space, and construct new space for necessary meetings.

Currently, 40 percent of Border Patrol agents are monitoring the migrants and children who have been apprehended. The Access to Counsel Act would make it more difficult for Border Patrol agents to do their job because this legislation would take even more agents away from patrolling the border.


BOTTOM LINE: House Democrats are prioritizing the needs of illegal immigrants over the safety and security of the American people. By loosening immigration restrictions in the middle of a global pandemic, Speaker Pelosi and her comrades are signaling to the world that the southern border is open to everyone, despite the risk of spreading COVID-19.
